Follow-up blog on UNOCH's court case

This morning UNOCH received a ruling IN OUR FAVOR from the United States District Court Southern District of California:
“Order Granting Plaintiff’s Motion to Compel Arbitration”
This means RCHSD is compelled by the court to arbitrate the new flu policy that UNOCH contends should have been negotiated.

What this means:
While this ruling is in reference to the “new” flu policy, it has far reaching implications. RCHSD will not be able to deny grievances (something they have been doing lately) based on “Management Rights.” Management Rights does not mean “we can do whatever we want.”

What is next:
UNOCH will now set an arbitration date with RCHSD to present before an arbitrator our case that the flu policy was implemented and is being enforced outside of the collective bargaining agreement. In the mean time, UNOCH is filing an appeal regarding the injunction we requested to stop the wearing of the masks and discriminatory green badges.

This is an important ruling for us! We’ll keep you posted on the appeal.
